These Terms of Service govern your access to and use of Zethinking, including the website available at zethinking.com, its artificial intelligence services, applications, tools, features, connected services, and related offerings.

Zethinking is an AI-powered online platform operated from Taleex, Mogadishu, Somalia.

In these Terms, “Zethinking,” “we,” “us,” and “our” refer to the operator of the Zethinking platform. “You” and “user” refer to the person or organization accessing or using the service.

By creating an account, accessing Zethinking, purchasing a subscription, or otherwise using the service, you agree to these Terms.

1. Eligibility

You must be at least 15 years old to use Zethinking.

Where the law in your country requires parental or guardian consent for a person of your age to use online services or permit the processing of personal data, you may use Zethinking only after obtaining valid consent.

You must have the legal capacity to enter into these Terms.

When you use Zethinking on behalf of a school, business, company, organization, government body, or other entity, you confirm that you have authority to bind that entity to these Terms.

2. Description of the Service

Zethinking provides access to artificial intelligence and productivity features that may assist users with:

General questions and conversations;
Education and tutoring;
Writing, rewriting, and summarization;
Research and web search;
Software development;
File and document analysis;
Image understanding or generation;
Voice-based interactions;
Connected applications;
Workplace and productivity tasks;
Other supported AI functions.

Zethinking may use third party artificial intelligence models, hosting providers, search services, voice providers, authentication services, payment processors, databases, and connected applications to provide these functions.

Certain features may not be available in every country, plan, model, device, or account.

We may add, modify, limit, suspend, or discontinue a feature where reasonably necessary for legal compliance, security, product development, cost management, technical maintenance, provider availability, or service reliability.

3. User Accounts

Some features require an Zethinking account.

You agree to:

Provide accurate and current information;
Maintain the security of your authentication methods;
Protect your email account, passkeys, login links, and security codes;
Not share your account with unauthorized persons;
Notify us promptly of suspected unauthorized access;
Keep your profile and contact information updated.

You are responsible for activity performed through your account, except where unauthorized activity results directly from Zethinking’s failure to apply reasonable security measures.

You may not:

Create an account using a false or stolen identity;
Impersonate another person or organization;
Sell, rent, or transfer your account;
Create multiple accounts to evade restrictions;
Circumvent usage limits or payment requirements;
Access an account without authorization.

We may require account, identity, age, payment, or ownership verification where reasonably necessary.

4. Authentication and Account Security

Zethinking may support authentication methods such as:

Email login;
Magic Link;
Google authentication;
Passkeys;
Multi-factor authentication;
Other approved authentication methods.

You must not share temporary authentication links, one-time codes, recovery credentials, or passkey access with another person.

Zethinking support will not ask you to provide your complete password, payment-card PIN, or one-time authentication code.

5. User Instructions and Personalization

Zethinking may allow you to save:

Custom instructions;
Response preferences;
Language preferences;
Occupation information;
Tutor preferences;
Model preferences;
Saved memories;
Other personalization settings.

Personalization settings may influence AI responses, but they do not guarantee that every instruction will be followed.

User instructions may be overridden where necessary by:

Platform safety requirements;
Applicable law;
Security controls;
Technical limitations;
Higher-priority system instructions;
Model-provider restrictions.

You are responsible for reviewing and updating your saved instructions and personalization settings.

6. Artificial Intelligence Output

6.1 Nature of AI-generated content

Artificial intelligence generates content through automated prediction and processing.

AI output may be:

Inaccurate;
Incomplete;
Misleading;
Outdated;
Biased;
Offensive;
Repetitive;
Unsuitable for your circumstances;
Similar to content generated for another user.

Zethinking does not guarantee that AI output is correct, complete, unique, original, lawful, or appropriate for a particular purpose.

You must independently review and verify important output before relying on it.

6.2 No professional relationship

Zethinking does not provide licensed:

Medical advice;
Legal advice;
Financial or investment advice;
Tax advice;
Accounting advice;
Psychological treatment;
Engineering certification;
Professional diagnosis;
Brokerage or trade-execution services.

Use of Zethinking does not create a doctor patient, lawyer client, adviser client, therapist client, fiduciary, or other licensed professional relationship.

You should consult a qualified professional before making decisions involving health, safety, legal rights, investments, taxes, regulated activities, or significant personal consequences.

6.3 Human responsibility

You remain responsible for:

Decisions made using AI output;
Verifying facts, sources, calculations, quotations, and citations;
Reviewing content before publishing or submitting it;
Obtaining any required professional or human approval;
Ensuring compliance with academic and workplace rules;
Ensuring that your use of output is lawful;
Assessing risks before taking action.

You must not describe AI-generated content as independently verified human work where that description would be false, deceptive, or prohibited.

7. Emergency Situations

Zethinking is not an emergency service.

Do not rely on Zethinking where a person may be in immediate danger or requires urgent medical, police, fire, mental health, or emergency assistance.

Contact the appropriate local emergency service or qualified professional directly.

Zethinking does not continuously monitor conversations for emergencies and cannot guarantee intervention.

8. User Content

“User Content” means any information or material you submit to Zethinking, including:

Prompts;
Messages;
Files;
Documents;
Images;
Audio;
Voice transcriptions;
Code;
Custom instructions;
Feedback;
Connected-app information;
Other submitted material.

You retain any ownership rights you already hold in your User Content.

You grant Zethinking a worldwide, non-exclusive, limited licence to host, process, copy, transmit, convert, modify, and display User Content only as reasonably necessary to:

Operate the service;
Generate requested output;
Save conversations and preferences;
Provide connected-app features;
Maintain platform security;
Detect misuse and fraud;
Provide customer support;
Comply with legal obligations;
Improve reliability and performance as described in the Privacy Policy.

You confirm that:

You have the right to submit the User Content;
Your User Content does not unlawfully violate another person’s rights;
You have obtained any permission required to submit another person’s personal data;
Your User Content does not violate these Terms.

9. Confidential and Sensitive Information

Do not submit information that you are not authorized to disclose.

You should avoid submitting unnecessary:

Passwords;
Authentication codes;
Payment-card details;
Government identification numbers;
Medical records;
Legal secrets;
Trade secrets;
Classified information;
Confidential employer information;
Private information belonging to another person.

Zethinking is not a substitute for a confidential professional communication channel.

10. Rights in AI Output

As between you and Zethinking, and to the extent permitted by applicable law and underlying provider terms, you may use output generated specifically for you for lawful personal or commercial purposes.

This does not guarantee that:

The output qualifies for copyright protection;
The output is unique;
Similar content will not be generated for another user;
The output is free from third-party rights;
Zethinking owns every element contained in the output.

You are responsible for reviewing output for intellectual property, privacy, confidentiality, and legal risks before using it publicly or commercially.

11. Acceptable Use

You must comply with the Zethinking AI Use and Safety Policy.

You may not use Zethinking to:

Violate applicable law;
Harm, exploit, threaten, harass, or deceive another person;
Facilitate terrorism, violence, or serious wrongdoing;
Develop, deploy, or distribute malware;
Steal credentials or personal data;
Commit fraud;
Facilitate child exploitation;
Violate privacy rights;
Infringe intellectual-property rights;
Circumvent platform safeguards;
Overload, disrupt, or attack the service;
Access systems without authorization;
Extract protected model or system information;
Resell unauthorized access;
Misrepresent Zethinking output as official professional advice;
Develop a competing service through unauthorized extraction or systematic copying.

12. Education and Academic Use

Zethinking may assist with learning, tutoring, explanation, revision, practice questions, and academic preparation.

You remain responsible for following the rules of your school, university, examination body, or educational institution.

You may not use Zethinking to:

Cheat during a closed examination;
Bypass proctoring;
Impersonate a student;
Submit fabricated research;
Create false citations;
Obtain restricted examination materials;
Submit AI-generated work as independently completed work where prohibited.

Tutor features are intended to support learning, not replace genuine participation and understanding.

13. Connected Applications

Zethinking may allow you to connect third-party applications, cloud storage services, code repositories, productivity tools, or other accounts.

By connecting an application, you authorize Zethinking to access and process information within the permissions you approve.

You are responsible for:

Reviewing requested permissions;
Ensuring that you have authority to connect the account;
Managing access within the third-party application;
Disconnecting applications you no longer use;
Reviewing content before allowing Zethinking to act on it.

Third-party applications are governed by their own terms and privacy practices.

Zethinking is not responsible for the availability, security, policies, independent conduct, or content of a third-party service.

14. Files and Uploaded Material

Files may be subject to limits based on:

File size;
File type;
Page count;
Subscription plan;
Security requirements;
Technical capacity.

Zethinking may reject, quarantine, restrict, or remove files that:

Contain malicious code;
Violate these Terms;
Present a security risk;
Exceed applicable limits;
Cannot be processed safely.

You should maintain independent copies of important files.

Unless expressly stated otherwise, Zethinking is not a permanent file-storage or backup service.

15. Private Chat

Zethinking may offer a Private Chat feature.

Private Chat must be deliberately activated by the user. Normal conversations are not treated as private by default.

When Private Chat is active:

The conversation is not intended to appear in normal saved chat history;
Content may still be processed temporarily to generate responses;
Content may be transmitted to relevant AI or infrastructure providers;
Automated safety and security systems may process the content;
Limited information may be retained temporarily for abuse prevention, security, legal compliance, or incident investigation.

Private Chat does not mean:

End-to-end encryption;
Processing only on your device;
Complete invisibility to service infrastructure;
Guaranteed immediate deletion from every provider or backup system.

Do not submit secrets or highly sensitive information merely because Private Chat is enabled.

16. Free and Paid Plans

Zethinking may offer:

Guest access;
Free plans;
Paid subscriptions;
Promotional access;
Trials;
Usage credits;
Organization plans.

Features and limits may vary by plan, including:

Available AI models;
Message limits;
Search access;
File sizes;
Image limits;
Voice access;
Research tools;
Memory;
Connected applications;
Storage;
Response capacity.

We may apply reasonable limits to maintain security, control misuse, manage provider costs, and ensure fair service availability.

17. Payments and Subscriptions

When purchasing a paid plan, you agree to:

Provide valid billing information;
Pay the displayed price;
Pay applicable taxes and transaction charges;
Authorize recurring charges where automatic renewal applies.

Unless otherwise stated during purchase:

Subscription fees are charged in advance;
Subscriptions renew automatically;
You may cancel before the next renewal date;
Cancellation stops future renewals;
Access normally continues until the end of the paid billing period;
Partial billing periods are not automatically refunded.

Prices may change.

Where required by law, Zethinking will provide reasonable notice before a changed recurring price applies.

18. Refund Policy

Payments are generally non-refundable after a billing period begins, except:

Where required by applicable law;
In cases of verified duplicate charges;
Where Zethinking charged an incorrect amount;
Where a paid service was not provided because of a verified platform failure;
Where Zethinking approves a refund after reviewing exceptional circumstances.

Refund requests should be submitted within 14 days of the relevant charge to:

The request should include:

Account email;
Transaction date;
Amount charged;
Reason for the request;
Relevant payment receipt or transaction identifier.

Approval is not guaranteed unless required by law.

Third-party app stores and payment platforms may apply their own refund procedures.

19. Trials and Promotional Access

Zethinking may offer free trials, promotional periods, or credits.

Promotional access may:

Be limited to one per user;
Expire after a stated period;
Be restricted by location or eligibility;
Exclude certain models or features;
Be withdrawn in cases of misuse.

Where a trial converts into a paid subscription, that condition must be disclosed before the user accepts the trial.

20. Beta and Experimental Features

Some features may be labelled:

Beta;
Preview;
Experimental;
Early access;
Research;
Testing.

Such features may:

Contain errors;
Be unavailable without notice;
Produce inconsistent output;
Change significantly;
Be discontinued;
Have different privacy or retention characteristics disclosed at activation.

Beta features should not be relied upon for critical or high-risk operations.

21. Intellectual Property

Zethinking and its licensors retain rights in the platform, including:

Software;
Interfaces;
Branding;
Logos;
Documentation;
Designs;
Databases;
Workflows;
System instructions;
Proprietary technology;
Platform-generated metadata.

Except where expressly permitted, you may not:

Copy protected parts of the service;
Reverse engineer the platform;
Decompile protected software;
Remove proprietary notices;
Scrape the service without authorization;
Sell or redistribute the platform;
Create derivative services from protected platform components;
Use Zethinking branding without written authorization.

22. Feedback

You may provide suggestions, ideas, reports, or other feedback.

You grant Zethinking permission to use that feedback for lawful platform development, without payment or restriction.

Zethinking will not publicly identify you as the source of feedback without permission.

23. Intellectual-Property Complaints

Rights holders may report allegedly infringing content by emailing:

A complaint should include:

Identification of the protected work;
Identification of the allegedly infringing content;
The location of the content;
Contact information;
Evidence of ownership or authorization;
A good-faith statement that the use is unauthorized;
A statement that the submitted information is accurate.

Zethinking may remove or restrict content and take action against repeat infringers where appropriate.

24. Suspension and Termination

You may stop using Zethinking at any time.

You may request account deletion through available account settings or by contacting legal@zethinking.com.

Zethinking may suspend, restrict, or terminate an account where reasonably necessary because of:

Serious or repeated policy violations;
Fraud;
Payment abuse;
Security risks;
Illegal activity;
Harm to users or third parties;
Unauthorized access;
A valid legal request;
Prolonged inactivity;
Discontinuation of the service.

Where appropriate and legally permitted, Zethinking may provide notice and an opportunity to appeal.

Termination does not remove liabilities or obligations that arose before termination.

25. Service Availability

Zethinking aims to provide a reliable service but does not guarantee uninterrupted, secure, or error-free availability.

Service availability may be affected by:

Maintenance;
Internet failures;
Cloud-provider outages;
AI-provider limitations;
Search-provider failures;
Cybersecurity incidents;
Legal restrictions;
Force majeure;
Technical problems;
Excessive demand.

Zethinking may temporarily limit features or usage to preserve security, fairness, stability, or availability.

26. Disclaimers

To the fullest extent permitted by law, Zethinking is provided on an “as is” and “as available” basis.

Zethinking disclaims implied warranties of:

Merchantability;
Fitness for a particular purpose;
Non-infringement;
Accuracy;
Availability;
Reliability;
Compatibility;
Uninterrupted operation.

Nothing in these Terms excludes a legal right or warranty that cannot lawfully be excluded.

27. Limitation of Liability

To the fullest extent permitted by law, Zethinking and its operators, personnel, contractors, affiliates, and service providers will not be liable for indirect, incidental, punitive, exemplary, special, or consequential losses.

This includes loss of:

Profits;
Revenue;
Data;
Business;
Reputation;
Opportunity;
Expected savings.

Zethinking’s total aggregate liability arising from the service or these Terms will not exceed the greater of:

The total amount you paid to Zethinking during the 12 months before the event giving rise to the claim; or
USD 100.

These limitations do not apply where liability cannot legally be excluded or limited.

28. Indemnity

Where permitted by law, you agree to indemnify Zethinking against third-party claims, losses, and reasonable costs arising from:

Your unlawful use of the service;
Your material violation of these Terms;
Your infringement of another person’s rights;
User Content you were not authorized to submit;
Your fraudulent or intentionally harmful conduct.

This obligation does not apply to the extent that a claim was caused by Zethinking’s own unlawful conduct.

29. Governing Law

These Terms are governed by the applicable laws of the Federal Republic of Somalia, without regard to conflict-of-law principles.

Mandatory consumer-protection rights available in a user’s country of residence may continue to apply where they cannot legally be excluded.

30. Dispute Resolution

Before filing a formal claim, you agree to contact:

Your notice should provide:

Your name and account email;
A description of the dispute;
Relevant dates;
The resolution requested;
Supporting information.

The parties will attempt to resolve the matter in good faith for at least 30 days.

If the dispute is not resolved, it may be submitted to the courts with appropriate jurisdiction in Mogadishu, Somalia, unless mandatory law permits the user to bring a claim elsewhere.

31. Changes to These Terms

Zethinking may update these Terms to reflect changes in:

The service;
Applicable law;
Safety requirements;
Security practices;
Payment arrangements;
Third-party providers;
Business operations.

The “Last Updated” date will be revised.

Where changes materially affect user rights, Zethinking will provide reasonable notice through the platform, email, or another appropriate method.

Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by law.

32. General Provisions

If a provision of these Terms is found invalid or unenforceable, the remaining provisions remain effective.

Failure to enforce a provision does not waive the right to enforce it later.

You may not transfer your rights under these Terms without written permission.

Zethinking may transfer its rights and obligations as part of a lawful restructuring, financing, acquisition, merger, or transfer of the platform.

These Terms, together with the Privacy Policy, AI Use and Safety Policy, Cookie Policy, Security Policy, and any plan-specific terms, form the agreement between you and Zethinking.
